A BILL to amend the Larceny Act, Cap. 4.16.
BE IT ENACTED by the King’s Most Excellent Majesty, by and with the advice and consent of the National Assembly of Saint Christopher and Nevis, and by the authority of the same as follows:
1. Short title.
This Act may be cited as the Larceny (Amendment) Act, 2025.
2. Interpretation.
In this Act
“Act” means the Larceny Act, Cap. 4.16.
3. Amendment of section 31.
The Act is amended in section 31 by replacing it with the following—
“31. Robbery.
(1) A person who—
(a) being armed with any firearm as defined under the Firearms Act, robs, or assaults with intent to rob, any person, commits a felony, and, on conviction, is liable to a term of life imprisonment with hard labour;
(b) being armed with any offensive weapon or instrument other than any firearm as defined under the Firearms Act, robs, or assaults with intent to rob, any person, commits a felony, and, on conviction, is liable to a term of imprisonment with hard labour of forty years;
(c) being together with one other person or more, robs, or assaults with intent to rob, any person, commits a felony, and, on conviction, is liable to a term of imprisonment with hard labour of thirty-five years;

(d) robs any person and, at the time of or immediately before or immediately after such robbery, uses any personal violence to any person commits a felony, and, commits a felony, and, on conviction, is liable to a term of imprisonment with hard labour of thirty years;
(e) robs any person, commits a felony, and, on conviction, is liable to a term of imprisonment with hard labour of twenty years;
(f) assaults any person with intent to rob, commits a felony, and, on conviction, is liable to a term of imprisonment with hard labour of fifteen years;
(2) For the purposes of this Act, a firearm as defined under the Firearms Act includes any firearm, imitation firearm, automatic firearm, restricted weapon, prohibited weapon or any other such firearm or weapon defined under the Firearms Act, Cap. 19.05.
(3) For the purposes of any sentencing guideline that requires a numerical value to be assigned for the statutory maximum, life imprisonment under paragraph (a) is deemed to be 50 years.”
